Wooden & McLaughlin’s involvement in environmental matters stems from its relationships with, not only commercial general liability insurance carriers and specialty insurers, but its direct relationships with chemical manufacturers and suppliers, as well as premises owners. The lawyers in this group handle essentially two types of cases. First, they are called upon by insurance carriers to defend claims asserted by insureds involved in environmental impacts.
Secondly, the lawyers in this group defend owners of real estate, as well as waste-producers, against claims brought by the Environmental Protection Agency, the Indiana Department of Environmental Management and/or neighboring landowners. The lawyers in this group have significant experience defending and prosecuting cost recovery claims and environmental liability under the Comprehensive Environmental Response Compensation and Liability Act
(CERCLA) and similar state laws. The cases often involve drycleaners, service stations, municipalities, and industrial manufacturers. Wooden & McLaughlin regularly shares its knowledge and experience in the cases as both lead counsel and local counsel to law firms from around the country.
