Matthew M. Adolay
Partner

Matt has a wide range of civil litigation experience, both commercial and tort.  He has appeared before federal and state trial courts throughout Indiana, and has argued before both the Indiana Supreme Court and the Indiana Court of Appeals.  Matt has also resolved many cases through alternative dispute resolution, including several mediations.  His primary goal is to provide his clients with efficient, practical, and effective counsel. 

Matt’s commercial litigation experience has included breach of contract matters, the protection of creditors’ rights, shareholder and business member disputes, construction disputes, and landlord/tenant law.

Landlord/tenant law is an area of particular focus for Matt.  He has represented both landlords and tenants in the work-out of commercial lease disputes, and strives to salvage relationships that can be salvaged if that best serves his clients’ interests.  When relationships cannot be salvaged, however, Matt is equipped to serve as an advocate for his clients’ rights under the lease and applicable law.  Matt has litigation experience with the termination of tenant possessory rights and the enforcement of tenant obligations, but he has also served to protect the legal rights of several commercial tenants. 

As an extension of his landlord/tenant practice, Matt also has experience with Indiana real estate tax appeals.  His representative cases have included both the challenge of over-assessed real estate and the denial of statutory exemptions to the payment of real estate taxes.  Matt has appeared both before local county Property Tax Boards of Appeals and the Indiana Board of Tax Review. 

Matt’s tort litigation experience has included product and premises liability cases, often times where serious injuries are being alleged.  Representative product liability cases have related to asbestos, manufacturing equipment or different types of consumer goods.  Representative premises liability litigation has involved slip/trip-and-fall cases, alcohol consumption cases, or other cases in which premises owners have been accused of failing to address dangerous conditions upon their land.  Matt has also represented several Greek and fraternal organizations in tort litigation throughout Indiana.
