Matt is a construction lawyer who helps developers, contractors and designer professionals navigate the complexities of the construction process. He provides day-to-day counsel from project inception to completion and guides his clients through dispute resolution when problems arise on the job.

Matt is also a seasoned commercial litigator with both trial and arbitration experience. So when construction or other business disputes arise, Matt has the background and training to help his clients develop the resolution strategy, whether that may be measured negotiation, or aggressive litigation. Matt has first chair trial experience in both bench and jury trials and has resolved many cases through alternative dispute resolution, including mediation and arbitration.

Representative Experience:
Construction:

Matt’s construction practice includes litigating construction and real estate disputes, advising construction clients, drafting and negotiating construction contracts, pursuing and defending mechanic’s lien and bond claims, litigating delay and defect claims, and counseling clients on default, termination and project management issues.

  • Matt provides ongoing construction related counsel to several of Indiana’s largest multi-family developers and construction companies, including risk management, contract drafting and negotiation, and dispute resolution.
  • In 2015 – 2016, Matt defended a prime contractor on the Grand Park sports complex in Westfield, Indiana, after the City of Westfield terminated the contractor (without notice) and sued for more than $3 million in damages.  Matt’s client counterclaimed for wrongful termination.  Matt filed a motion for summary judgment on all of the City’s claims, and while that motion was pending, negotiated a favorable settlement of the City’s claims.
  • In 2016, Matt defended a developer and property management company in several lawsuits filed by the Marion County Health & Hospital Corporation claiming that the property manager’s properties violated the Health Code for having pool fences of insufficient height.  Matt ultimately sought and obtained a variance from the Fire and Safety Commission which resulted in the dismissal of the county’s lawsuits.
  • In 2014 – 2015, Matt represented an electrical subcontractor on a $100 million+ industrial project that had significant cost overruns and delays.  Matt negotiated for the prompt payment of funds that the general contractor was improperly withholding from Matt’s client.  Matt eventually negotiated a settlement that was later approved by the bankruptcy court after the contractor filed for Chapter 11 bankruptcy.
  • In 2014, Matt defended a telecommunications subcontractor in a payment dispute in a multi-party lawsuit brought by a sub-subcontractor that involved underlying insurance claims for defective work of another subcontractor.  Matt efficiently managed the litigation and settled the case on terms favorable to his client.
  • In 2011, Matt defended a general contractor in a breach of contract dispute with one of its subcontractors on a large mixed-use project in Carmel, Indiana.  After Matt filed a motion for summary judgment, the case quickly settled.

 Real Estate and Commercial Litigation:

 Matt’s commercial litigation experience includes foreclosing mortgages, defending mortgage loan servicers, asserting and defending title insurance claims, litigating tax sale disputes, applying for court-ordered receiverships, negotiating debt workouts, prosecuting and defending preferential transfer and fraudulent conveyance claims, and representing clients in complex commercial litigation matters involving landlord/tenant disputes, business disputes, business torts, and claims for breach of contract.

  • Matt has represented several commercial developers facing foreclosure of their properties.  Matt advised the developers on how to achieve positive workouts with their lenders.
  • Matt has represented both commercial property owners and residential mortgage servicers in numerous mortgage foreclosure and receivership proceedings.
  • In 2016, Matt was co-counsel in a four-day court trial in Vanderburgh County for a lender and its broker.  In addition to prosecuting the client’s commercial foreclosure claim having a value in excess of $3.0M, Matt defended the clients against a multitude of contract and tort counterclaims asserted by the homeowner.  The trial court ruled in favor of Matt’s clients on all accounts.  The homeowner appealed, and on May 4, 2017, the Court of Appeals affirmed.
  • In 2015, Matt successfully defended a homeowner facing litigation filed by his neighbors who claimed to have a prescriptive easement of the homeowner’s property.  After Matt filed a motion for summary, the neighbors quickly retreated, and ultimately settled for no compensation.
  • In 2015, Matt pursued a fraud lawsuit on behalf of a house flipper that resulted in the recovery of all funds lost.
  • In 2014-2016, Matt defended a medical device manufacturer in a multi-district products liability action that required him to travel the country deposing plaintiffs and physicians.
  • In 2014, Matt successfully defended a corporate executive who was being sued by the former president of the company on claims that the current executive should be personally liable for unpaid wages.  Despite the fact that Matt’s client had already been defaulted when Matt was hired, Matt successfully vacated the default and got all claims against his client dismissed.
